§ 54-205. Subpoenas; defaults.

  • (a)

    At any time prior to the hearing date, the hearing officer assigned to hear the case may, at the request of the building inspector or the attorney for the village, or the property owner or his attorney, issue subpoenas directing witnesses to appear and give testimony at the hearing. The party requesting a subpoena shall serve, via first class mail, copies of any and all subpoenas on all parties to the action.

    (b)

    If, on the date set for hearing, the property owner or his attorney fails to appear, the hearing officer may, after determining that proper notice of hearing has been given, proceed ex parte and find the property owner in default and shall proceed with the hearing and accept evidence and testimony relevant to the existence of a code violation.
