§ 44-141. Permit required; fee.

  • (a)

    It shall be unlawful for any person to place, or cause to be placed, a roll-off container or other container for the collection and storage of construction and demolition debris on any public or private property within the village without having first obtained a roll-off container permit.

    (b)

    An application for a roll-off container permit requesting the location of a roll-off container on private property or on a public street, along with the required permit fee, shall be filed with the zoning enforcement administrator by the owner or authorized agent of the owner of the property proposed to be serviced by the roll-off container. The zoning enforcement administrator shall review the permit application; and, if the application discloses that the roll-off container complies with the requirements of this chapter, the zoning enforcement administrator shall issue the permit to the applicant.

    (c)

    A roll-off container permit is valid for the period that the roll-off container is located at the permitted location, not to exceed 30 days for projects:

    (1)

    Having a building permit value of $100,000.00 or less; or

    (2)

    Projects adding less than 50 percent to the interior space of an existing building;

    (d)

    A roll-off container permit is valid for the period that the roll-off container is located at the permitted location, not to exceed 90 days for projects:

    (1)

    Having a building permit value in excess of $100,000.00;

    (2)

    Projects adding 50 percent or more to the interior space of an existing building; or

    (3)

    Projects involving the demolition of an existing building and replacement of the demolished building with a new building.

    (e)

    The roll-off container permit shall be obtained by the owner or authorized agent of the owner of the property where the roll-off container or other container for the collection and storage of construction and demolition debris will be placed or, if the roll-off container is to be located on a public street, the permit shall be obtained by the owner or authorized agent of the owner of the property from which the construction and demolition debris placed in the roll-off container originates. A roll-off container permit is renewable once for a like period of time as the original roll-off container permit upon payment of the renewal fee and the filing of a renewal application with the zoning enforcement officer. After the initial renewal period, a roll-off container permit may be renewed by the village manager for additional periods of up to 30 days upon the payment of a renewal fee and the filing of an application setting forth circumstances beyond the control of the owner or occupant of the property justifying the renewal.

    (f)

    The permit fee and, if applicable, the permit renewal fee shall be paid in accordance with the village fee schedule.

    (g)

    A hold harmless agreement signed by the owner of the property where the roll-off container or other container for the collection and storage of construction and demolition debris will be placed shall be submitted prior to the roll-off container permit's being issued.

    (h)

    It shall be a condition to the issuance of a roll-off container permit that the service providing the roll-off container shall hold a current, valid scavenger's license with the village.

    (i)

    A roll-off container permit shall not be required for any construction projects having roll-off container use approved by the village board of trustees as a part of final planned development approval.
