§ 54-171. Definitions.

  • The following words, terms and phrases, when used in this subdivision, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Administrative fee means the fee as provided in the village fee schedule imposed by the village pursuant to this subdivision related to its administrative and processing costs associated with the investigation, arrest and detention of an offender arrested for a criminal offense listed in this subdivision, or the removal, impoundment, storage and release of the motor vehicle operated, used, or in the physical control of the offender on any public highway or roadway within the village during the commission of, or in furtherance of, any criminal offense listed in this subdivision.

    Hearing officer means an attorney licensed to practice law in this state for a period in excess of three years, appointed by the village to serve and preside as the hearing officer for the village's administrative adjudication hearing system.

    Motor vehicle means    every vehicle which is self-propelled as defined by the Illinois Vehicle Code, 625 ILCS 5/1-146, except a vehicle which is propelled by electric power obtained from overhead trolley wires, but not operated upon rails, vehicles moved solely by human power, and motorized wheelchairs.

    Offender means any person who is the registered owner of a motor vehicle, who is the agent of the registered owner of a motor vehicle or who is in physical control of a motor vehicle with the express or implied permission or consent of the registered owner and who is arrested for the commission of an offense listed in this subdivision and was operating or using the motor vehicle during the commission or in furtherance of any criminal offense listed in this subdivision.

    Registered owner means    the record titleholder to a motor vehicle, as registered with the secretary of state or any other applicable governmental agency.
