§ 54-114. Determination of liability.

  • A final determination of a violation liability for a vehicular parking violation, compliance violation or automated traffic law violation liability shall occur following:

    (1)

    The failure to request a hearing on the merits of the violation in the time and manner specified on the violation notice and pay the fine indicated on the violation notice by the deadline stated on the violation notice;

    (2)

    The failure by a person requesting a hearing to attend the hearing to contest the alleged violation in the time and manner specified in a prior mailed notice and the hearing officer's determination of violation liability, followed by:

    a.

    The denial of a timely petition to set aside that determination; or

    b.

    Upon expiration of the period for filing such a petition without a filing having been made; or

    (3)

    The failure to pay the fine or penalty after a hearing officer's determination of violation liability and the exhaustion of or failure to exhaust any administrative review procedures provided by this division.
