§ 54-106. Hearing officer.

  • There is hereby established the office of hearing officer. The village manager is authorized to appoint one or more hearing officers. A hearing officer shall perform such duties as defined within this article and is hereby authorized to:

    (1)

    Preside over the administrative hearings, established herein, as the adjudicator.

    (2)

    Administer oaths.

    (3)

    Issue subpoenas to secure the attendance of witnesses and production of relevant papers or documentation.

    (4)

    Assess fines and penalties for the violation of vehicular parking violations, compliance violations and automated traffic law violations as set forth in this Code provided no fine shall exceed $250.00 per violation, excluding, however, parking in a parking space reserved for persons with disabilities.

    (5)

    Make final determinations of:

    a.

    Vehicular parking violation, compliance violation and automated traffic law violation liability;

    b.

    Validity of notices of impending vehicle immobilization and impoundment;

    c.

    Validity of the immobilization, towing and impoundment of vehicles; and

    d.

    Validity of notice of impending drivers license suspension in accordance with the provisions of this chapter.

    (6)

    Provide for the accurate recordation of the administrative adjudication hearings.
