§ 44-224. Service procedure and requirements.
(a)
Service provided Mondays through Saturdays shall not commence before 7:00 a.m. and shall cease by 7:00 p.m. While circumstances may require Sunday collection, on that day the contractor shall not commence work before 9:00 a.m. and shall cease collection by 7:00 p.m.
(b)
All refuse, recyclables, and yard waste collected must be removed from the village as soon as the materials are collected, but in any event no later than 7:00 p.m. of the date of collection.
(c)
Fees charged for the collection or processing of refuse and yard waste shall be negotiated directly between the contractor and the customer.
(d)
Contractors licensed to provide regular commercial, industrial and institutional service shall provide recycling service of the materials collected in the village's regular residential recycling program at no additional fee to their commercial, industrial or institutional customers. Such listing of recyclable material may be obtained from the village manager's office. Such contractors shall be required to offer a minimum of a once-per-week pickup of refuse and recycling materials.
(e)
Contractors licensed to provide regular commercial, industrial and institutional service shall provide for the collection of yard waste from their customers as required.
(f)
The contractor shall collect and maintain accurate data and records of the refuse, recyclable material and any yard waste collection programs, including, but not limited to, a total weight or cubic yardage of general refuse, recyclables and yard waste on a monthly basis; recycling information per month by category, sales and weight; the names of all disposal facilities and transfer stations, composting sites, processing facilities for refuse, recyclables and yard waste, and other such information as may be required for the providing of accurate information to any local, country, state or federal agency requiring the reporting of such information.
(g)
All contractors shall furnish competent employees in providing refuse collection services. Employees shall wear proper attire at all times while performing work within the village.
(h)
All contractors shall be equipped and possess the competence necessary to develop and operate the level of services for which they seek to be licensed by the village. The village reserves the right to conduct such investigations as necessary to verify the contractor's ability to provide service, including, but not limited to, field inspection of operation sites, equipment and equipment yards.
(i)
All vehicles used for the collection of refuse, recyclable materials and yard waste shall be maintained in good working order and appearance, free of rust, and shall be clean at the start of each collection day. No vehicle shall be operated on village streets or alleys which leaks any fluids from the engine or compacting mechanism. In the event that any vehicle is not properly operable, a suitable vehicle shall immediately be provided that complies with the terms herein. All vehicles shall display the name of the contractor, a local phone number, and a vehicle identification number that is clearly visible on both sides.
(j)
All vehicles shall be fully enclosed, leak-proof and operated in such a way that no refuse, recyclables or yard waste leaks, spills or blows off the vehicles. Should any refuse, recyclable material or yard waste leak, spill or blow off a vehicle due to vehicle operator's failure to properly monitor the load or to close openings or due to failure of any mechanism, the contractor shall be responsible for collecting or cleaning up such litter or fluids. Drain plugs, if available, shall be kept closed except during collections made in rainy weather. All vehicles shall be made available for inspection during regular business hours at the request of the village, in addition to yearly inspection requirements of the contractor's annual business licenses.
(k)
All spills of any refuse, recyclable materials or yard waste on any private property, parkways, streets, sidewalks, alleys or other public place shall be immediately cleaned up; and the area shall be left in a neat and cleanly manner.
