§ 2-699. Removal or suspension of firefighter and police officer.

  • (a)

    No officer or member of the fire or police division who shall have been appointed under the rules and examinations provided for by this article shall be removed or discharged except for cause, upon written charges, and after an opportunity to be heard in his own defense.

    (b)

    Any such charges shall be investigated by the board of fire and police commissioners and, in case such officer or member is found guilty, such board may remove or discharge him, or may suspend him for not exceeding ten days without pay.

    (c)

    The board of fire and police commissioners may suspend any officer pending such investigation, but not to exceed 30 days at any one time.

    (d)

    In the conduct of such investigation, each member of such board shall have power to administer oaths and affirmations and such board shall have power to secure, by its subpoena, both the attendance and testimony of witnesses and the production of books and papers relevant to such investigation.
